Terms and Conditions

1. Scope

These General Terms and Conditions (GTC) govern the contractual relationship between Skulltress GmbH, located at Stallikonerstrasse 25, 8903 Birmensdorf ZH, Switzerland (hereinafter “Skulltress”), and all persons who purchase products through the online store at www.skulltress.ch (hereinafter “Customer”).

These Terms and Conditions, in the version in effect at the time of the order, apply exclusively to all orders.

Any terms and conditions proposed by the customer that differ from these will not be accepted, unless Skulltress has expressly agreed to their validity in writing.

In addition, the Swiss Code of Obligations (CO) applies.

2. Information in the online store

All information in the online store (e.g., product descriptions, images, prices, quantity details) is provided for informational purposes only and does not constitute a representation of characteristics or a warranty, unless expressly stated otherwise.

Skulltress makes no warranty regarding:

  • the constant availability of the products
  • their availability
  • accurate or complete information

Products, prices, or technical specifications are subject to change at any time.

3. Conclusion of the Contract

The presentation of products in the online store does not constitute an offer, but rather a non-binding invitation to place an order.

By placing an order and accepting these Terms and Conditions, the customer submits a binding offer.

The contract is concluded as soon as Skulltress confirms the order by email.

Orders placed are binding.

A general right of withdrawal or return applies only in accordance with these Terms and Conditions.

4. Prices and Payment Terms

The prices displayed in the online store are in Swiss francs (CHF) and include applicable sales tax.

4.1 Shipping Costs

Shipping costs are displayed during the ordering process.

B2B / Wholesale:

Free shipping is available within Switzerland and Liechtenstein for orders of 70 items or more.

4.2 Payment Options

The payment methods listed during the ordering process are available.

Skulltress may exclude customers from using certain payment methods or require payment in advance for all deliveries.

The goods remain the property of Skulltress until full payment has been received.

5. Delivery

5.1 Delivery Time

Orders are usually shipped within two business days.

Orders placed by 4:00 p.m. (Monday–Friday) will be shipped the same day.

Delivery times are not binding. Skulltress assumes no liability for delivery delays.

5.2 Transfer of Risk

Upon shipment, the benefits and risks pass to the customer.

6. Obligation to Inspect, Notice of Defects, and Returns

The customer must inspect the delivered goods immediately upon receipt.

Any defects must be reported to Skulltress in writing within 10 days:

Returns are at the customer's expense and risk, unless Skulltress has expressly agreed to cover the return shipping costs.

7. Returns & Exchanges

7.1 Returns Due to Defects

Returns are only accepted for items purchased directly from the Skulltress online store.

In the event of valid defects, the customer will receive, at Skulltress’s discretion:

  • a replacement shipment, or
  • a refund of the purchase price.

7.2 Incorrect Order Placed by the Customer

If the customer makes a mistake, Skulltress may offer an exchange as a gesture of goodwill.

8. Right of Withdrawal (B2C only)

Private customers have a 14-day right of withdrawal, starting from the date the contract is concluded or the goods are received.

The notice of withdrawal must be sent to:

Consequences of the revocation

Skulltress will refund all payments, including standard shipping costs, within 14 days of receiving the cancellation notice.

The refund will be issued via the same payment method. The customer is responsible for the cost of returning the merchandise.

Exclusion of the Right of Withdrawal

The right of withdrawal expires if:

  • Delivery of sealed goods that cannot be returned for health or hygiene reasons, provided that the seal has been broken after delivery (e.g., opened tattoo oils or balms).
  • Goods that have been manufactured according to the customer's specifications or are clearly tailored to the customer's personal needs.

9. Warranty

Skulltress delivers products of impeccable quality.

If defects are reported in a timely manner, you are entitled to:

  • Replacement shipment or
  • Refund

Any further claims (e.g., consequential damages) are excluded.

Defects resulting from improper use are not covered.

10. Liability

Skulltress is liable only for damages resulting from willful misconduct or gross negligence.

Any further liability—in particular for indirect damages, lost profits, or consequential damages—is excluded.

11. Intellectual Property

All rights to content, designs, product images, logos, and trademarks are owned by Skulltress GmbH or are licensed.

Any use without written consent is prohibited.

12. Privacy Policy

Personal data is handled in accordance with the Swiss Data Protection Act (DSG).

13. Changes to the Terms and Conditions

Skulltress may amend these Terms and Conditions at any time.

The version in effect at the time of the order applies.

14. Final Provisions

If any provision is invalid, the validity of the remaining provisions shall remain unaffected.

The invalid provision shall be replaced by a provision that most closely reflects the economic purpose.

15. Jurisdiction & Governing Law

This agreement is governed exclusively by Swiss law, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).

The place of jurisdiction is Birmensdorf/ZH, unless mandatory statutory places of jurisdiction apply.
